Terms of Service

1. Acceptance of Terms

By accessing or using Verkh ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Verkh provides DMARC monitoring, email authentication analysis, DNS validation, and related services. The Service helps organizations monitor, analyze, and improve their email authentication configuration.

3. Account Registration

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access
• One person or entity may not maintain multiple free accounts
• You must be at least 16 years old to use the Service

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Monitor domains you do not own or have authorization to monitor
• Attempt to gain unauthorized access to our systems
• Interfere with other users' use of the Service
• Reverse engineer or attempt to extract source code
• Use automated systems to access the Service beyond normal use
• Resell or redistribute the Service without a partner agreement

5. Domain Ownership

By adding a domain to Verkh, you represent that you own or have authorization to monitor that domain. We may require verification of domain ownership. We reserve the right to remove domains that appear to be monitored without authorization.

6. Subscription and Billing

6.1 Plans and Pricing

The Service is offered in multiple tiers (Free, Starter, Pro, Enterprise) with different features and limits. Current pricing is available at verkh.io/pricing.

6.2 Payment

• Paid subscriptions are billed monthly or annually in advance
• Refunds are subject to our Refund Policy
• We may change pricing with 30 days notice
• Failed payments may result in service suspension

6.3 Free Trials

Free trials provide access to paid features for a limited time. At trial end, you will be downgraded to the Free tier unless you subscribe. No credit card is required for trials.

6.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access until then. Downgrading may result in loss of data beyond the lower tier's retention limits.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference. You retain ownership of data you provide. We process your data only to provide the Service.

8. Intellectual Property

The Service, including its design, features, and content, is owned by Verkh, LLC and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service. Your use of the Service does not grant you ownership of any intellectual property.

9. Third-Party Services

The Service may integrate with third-party services (e.g., Google Workspace, email providers). Your use of those services is governed by their respective terms. We are not responsible for third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. DMARC monitoring is informational and does not guarantee email deliverability or security.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERKH, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Verkh, LLC from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Service Availability

We target 99.99% uptime but do not guarantee availability. We may perform maintenance with reasonable notice. We reserve the right to modify or discontinue features with notice.

14. Termination

We may suspend or terminate your access to the Service for violation of these Terms or for any reason with notice. Upon termination, your right to use the Service ceases immediately. Data may be deleted after account termination.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting notice on the Service or via email. Continued use after changes constitutes acceptance. If you do not agree to modified Terms, you must stop using the Service.

17. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and Verkh, LLC
• Severability: If any provision is unenforceable, the remainder stays in effect
• Waiver: Failure to enforce a provision is not a waiver of our right to enforce it
• Assignment: You may not assign these Terms without our consent
